1. Overview

This website, pemexpressions.com, is operated by PEM Expressions Jewelry ("we," "us," "our"). By visiting our site or buying from us, you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the site. Our store is hosted on Shopify, which provides the platform we use to sell our products.

2. Eligibility

By placing an order, you confirm that you're at least 18 years old, or that you have the consent of a parent or guardian.

3. Products and Descriptions

  • Natural materials. Pearls, jade, and other gemstones are natural materials. Size, shape, color, luster, and surface characteristics vary, and small natural marks are part of their character, not defects.
  • Measurements. Sizes and weights are approximate.
  • Photos. We photograph each piece as accurately as we can, but color may look different depending on your screen and lighting.
  • Certificates. Where a piece comes with a pearl or gemstone certificate, it reflects the issuing lab's or supplier's assessment.
  • Availability. Many pieces are one of a kind and sold on a first-come basis.

4. Pricing and Payment

  • All prices are in US dollars and may change without notice.
  • We may correct pricing errors and may cancel orders placed at an incorrect price; if we do, you'll receive a full refund.
  • Payment is due at checkout. We accept the payment methods shown at checkout.
  • Applicable sales tax is calculated at checkout.

5. Orders

We may refuse or cancel any order, including orders that look fraudulent, orders over quantity limits, or orders affected by an error in a product listing or price. If we cancel after you've been charged, we'll refund you in full.

6. Custom Orders

Custom or made-to-order pieces are made to the specifications you approve. They're final sale unless they arrive damaged or defective, or don't match what was agreed in writing.

7. Shipping and Returns

Shipping is covered by our Shipping Policy. Returns and refunds are covered by our Refund Policy. Both are part of these Terms.

8. Jewelry Care

Pearls and gemstones are delicate. Keep them away from perfume, lotion, chlorine, and harsh chemicals, and store them separately to avoid scratches. We aren't responsible for damage caused by normal wear, accidents, improper care, or alterations made by someone else.

9. Intellectual Property

All content on this site, including photos, videos, product descriptions, logos, and the PEM Expressions name, belongs to PEM Expressions Jewelry. You may not copy or use it without our written permission.

10. Reviews and Submissions

If you send us reviews, photos, or other content, you give us permission to use, display, and share it in connection with our store and marketing. You confirm that the content is yours to share and isn't unlawful or misleading.

11. Third-Party Links and Services

Our site may link to, or use, third-party services such as payment processors, shipping carriers, and social media. We aren't responsible for their content, terms, or practices.

Our Privacy Policy explains how we handle your personal information.

13. Disclaimer

Except as stated in our policies, the site and products are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all other warranties, express or implied.

14. Limitation of Liability

To the fullest extent allowed by law, PEM Expressions Jewelry is not liable for indirect, incidental, special, or consequential damages arising from your use of the site or products. Our total liability for any claim will not exceed the amount you paid for the product involved.

15. Indemnification

You agree to indemnify and hold harmless PEM Expressions Jewelry from claims arising out of your breach of these Terms or your misuse of the site.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be handled in the courts of Osceola County, Florida.
